The Nebraska Cottage Food Act, Neb. Rev. Stat. §81-2,280, governs home food sales statewide, not the county or city. A producer registers with the Nebraska Department of Agriculture at no charge before selling, and may sell directly to consumers at farmers markets, from home, online, and by delivery. LB 262 (2024) expanded the allowed foods to include some items needing refrigeration or heating, such as cheesecakes, sauces, and salsas, alongside the traditional baked goods, jams, and candies. Meat, poultry, and fish are excluded, and products must be labeled and made with safe-handling practices. Unlike many states, Nebraska sets no annual dollar limit on cottage food sales.
Selling without registering with the Department of Agriculture, skipping the required labeling, or offering excluded foods such as meat can pull the operation under full food-establishment permitting and state enforcement.
