Minnesota Statute 28A.152 exempts an individual who prepares and sells non-potentially-hazardous food, and certain home-canned pickles, vegetables or fruits with a pH of 4.6 or lower, from state food-handler licensing. Sales may be made directly to the ultimate consumer at a community event or farmers' market, or from the person's home to the extent allowed by local ordinance. Products must be labeled with the producer's name and address and the statement that they are homemade and not subject to state inspection. Producers must register annually with the Minnesota Department of Agriculture (a $30 fee applies above a low sales threshold) and are limited to gross receipts of $78,000 or less per calendar year.
