Ocoee residents may operate a Florida Cottage Food Operation under FL Β§500.80, selling up to $250,000 per year in approved non-hazardous home-produced foods without a food license or commercial kitchen. Local governments cannot ban cottage food operations.
FL Β§500.80 (amended 2021) authorizes direct-to-consumer sales of baked goods, jams, jellies, candies, honey, and other shelf-stable foods from the producer's home kitchen. Sales may be in person, by mail, or online. Labels must include the operator's name, address, ingredients, allergens, and the statement: Made in a cottage food operation that is not subject to Florida's food safety regulations. Cottage food operators still need an Ocoee Business Tax Receipt and must follow home occupation rules (no signage, limited customer traffic). Meat, seafood, dairy, and wet-pack canned items are excluded and require a commercial facility. Sales tax applies under FL Department of Revenue rules.
Operating outside Β§500.80 product list or over the $250,000 cap: FDACS enforcement and potential commercial license requirement. Mislabeling: FDACS inspection and corrective action. City-level issues usually limited to BTR and home occupation compliance.
