Ohio's statewide cottage food law lets you make and sell non-hazardous foods—baked goods, jams, jellies, candy, dry mixes—from home with no license, registration, or inspection, as long as products are correctly labeled. This is state law, uniform across Butler County.
Under ORC 3715.01 and OAC Chapter 901:3-20, a "cottage food production operation" produces specified non-potentially-hazardous foods in the person's home and is exempt from licensing and inspection by the Ohio Department of Agriculture. Allowed items include breads, cookies, cakes, fruit pies, candy, jams, jellies, fruit butters, dry herbs and mixes, popcorn, and granola. Products must carry a proper label (name, address, ingredients, net weight, and the required cottage-food statement) or they are deemed misbranded. Sales are permitted in Ohio, including online within the state. The county does not add its own cottage-food permit.
Mislabeled or adulterated cottage foods can be sampled by the director of agriculture and deemed misbranded/adulterated, subject to state enforcement. Making non-approved (potentially hazardous) items requires a full food license.
