Full Breakdown
' The same subsection carves out an exception for businesses that hold classes or give instruction, letting the director of community development approve up to six students present at once if the director finds the additional students will not generate added vehicular traffic, noise, or vibration from the premises. This traffic cap sits alongside related standards in the same section: subsection 3 limits the business to a single employee vehicle parked on the property or the residential street, capping off-street parking created for the business at two spaces, and subsection 4 limits truck deliveries to daily mail/package service plus two weekly deliveries by vehicles under 16,000 pounds and two axles, allowed only between sunrise and sunset.
Subsection 6 further limits staffing to residents of the property plus one non-resident employee. 4426 lets the operator apply to the board for a modification, with a $100 nonrefundable filing fee and mailed notice to property owners within 300 feet, provided the site is physically suitable and the change will not alter the residential character of the neighborhood.
Violations & Fines
Exceeding the three-visitor cap without an approved modification is a home-based business license violation, enforced under the business license ordinance's general misdemeanor penalty at § 25.443, punished as provided in § 125.050, and it is grounds for the license division to deny, suspend, or revoke the home-based business license.
