Home occupations in Virginia Beach must not generate customer traffic that is out of character with a residential neighborhood. The Zoning Ordinance permits only limited client visits by appointment, caps on-site employees at one non-resident, and prohibits retail sales, drop-in customer traffic, or deliveries beyond those typical for a residence. Family day homes under Virginia Code Β§22.1 are treated separately and explicitly permitted.
The customer-traffic limits in the Virginia Beach Home Occupation standards serve to preserve residential character. Client visits are permitted only by appointment and generally must be limited in frequency so that the home occupation does not become a de facto commercial operation. The ordinance prohibits retail sales of goods or merchandise not produced on the premises, meaning home occupations cannot serve as storefronts for ordered inventory. Commercial deliveries must be limited to those consistent with residential pickup and drop-off; tractor-trailer or box-truck deliveries are not allowed. Music lessons, tutoring, therapy, tax preparation, and similar by-appointment services are common approved uses provided overlapping client visits are avoided so on-street parking demand stays low. Generating frequent customer traffic and on-street parking demand is the single most common reason for neighbor complaints and zoning enforcement against home occupations. Family day homes caring for up to twelve children are authorized by Virginia Code Β§15.2-2292 and Β§22.1-289.02, and localities cannot prohibit them, but operators must still comply with state licensing through the Virginia Department of Education, Office of Child Care Health and Safety, and give neighbor notice before licensing. Violations are enforced under Zoning Ordinance provisions with civil penalties up to $500 per day.
Specific penalty amounts for this ordinance are not published in a publicly accessible fine schedule. Contact Virginia Beach code enforcement directly for current fines, enforcement procedures, and hearing options.
