Horry County zoning allows home occupations, but childcare in a home is governed statewide by the South Carolina Children's Code, Title 63, Chapter 13. A family childcare home is a residence where care is regularly provided for no more than six children (counting the operator's own resident children and related children in care). Operators must register with the SC Department of Social Services; they may elect to be licensed. Care for more than six children moves the operation into group or center licensing with stricter standards. County home-occupation limits on floor space, staff and signs also apply.
Operating an unregistered family childcare home, or exceeding the six-child limit without proper licensing, violates state law and can be enforced by SC DSS.
