North Carolina defines a family child care home in G.S. 110-86 as a child care arrangement in an operator-occupied private dwelling serving more than two but less than eleven children. Once you exceed two unrelated children present more than four hours a day, you must be licensed by the NC Division of Child Development and Early Education (DCDEE) under 10A NCAC 09; operating unlicensed is a Class I felony. In unincorporated Guilford County, a home daycare must also comply with the county's home-occupation zoning standards through Planning & Development.
Willfully operating a family child care home without a DCDEE license is a Class I felony under NC child-care law. Zoning noncompliance is separately enforceable by Guilford County Planning & Development under NC Gen. Stat. Chapter 160D.
