In-home daycare in Baltimore County is regulated by the State (MSDE) under COMAR 13A.15. An individual may not operate a family child care home without a valid certificate of registration, and total capacity may not exceed eight children, of whom no more than four may be under age 2.
Maryland COMAR 13A.15.02.01 requires that, except for limited exemptions, "an individual may not operate a family child care home unless: (a) Both the individual and the home meet the requirements for registration set forth in this subtitle; and (b) The individual possesses a valid certificate of registration." Exemptions include care by a relative of each child, or by a friend on a nonregular basis of less than 20 hours a month.
