Summary

El Dorado County allows small and large family child day care homes by right in any zone that permits detached single-unit dwellings, per Section 130.40.110 of the zoning code. Large homes must still meet parking, spacing, and pool-safety standards, and the operator needs a valid state license within 180 days.

These county ordinances apply to unincorporated areas of El Dorado County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Full Breakdown

70. Both small family day care homes (up to 8 children) and large family day care homes (up to 14 children) are allowed by right, meaning no discretionary planning permit is required to open one in a qualifying residential zone. That said, Subsection E imposes specific operating standards. 67. Large family day care homes carry additional site standards: the property must provide at least two off-street parking spaces, none of which may sit in a garage or carport (though these can double as required residential parking); the home cannot sit within 500 feet of another large family day care home, measured property line to property line; any pool or spa on-site must meet current fencing, gate-latch, and alarm requirements; no more than one family day care home may operate per lot; and the permit itself is non-transferable if the property or provider changes.

Vehicle loading and unloading for drop-off and pick-up is restricted to the driveway, an approved parking area, or the site's road frontage, and it cannot block traffic flow; facilities on higher-speed roads (35 mph design speed or more) or roads shown on the General Plan's Figure TC-1 must provide a dedicated drop-off/pick-up area engineered so vehicles do not back into the roadway. Where an Administrative Permit is required for a related facility type, the Director must act within 45 days of a complete application, and neighboring residentially zoned property owners within 100 feet get at least 10 days' written notice before a decision, with the right to request a hearing before the Zoning Administrator.

Violations & Fines

Operating a large family day care home without the required two off-street parking spaces, within 500 feet of another large day care home, or without a compliant pool fence/gate/alarm setup is a zoning violation handled under Code Enforcement Chapter 130.67, which can lead to permit revocation. Failing to obtain and submit a valid state license within the required timelines can likewise void the Administrative Permit. Decisions by the Director are appealable to the Planning Commission and then the Board of Supervisors under Section 130.52.090.

Frequently Asked Questions

Do I need a permit to run a small family day care home in El Dorado County?
No. Section 130.40.110(A) allows both small family day care homes (up to 8 children) and large family day care homes (up to 14 children) by right in any zone that permits detached single-unit dwellings, so no discretionary planning permit is required to start one.
What extra rules apply to a large family day care home?
Large homes must provide at least two off-street parking spaces outside any garage or carport, sit at least 500 feet from another large family day care home, meet current pool or spa fencing and alarm codes if applicable, and limit the property to one family day care home per lot; the permit cannot be transferred to a new operator.
How long do I have to get my state day care license?
You must obtain a valid state license to operate within 180 days of any Administrative Permit issuance and provide a copy to the Director within 14 calendar days of receiving it, per Section 130.40.110(E)(3); missing this can lead to permit revocation under Chapter 130.67.
