Ohio, not the county, regulates in-home child care. ORC 5104.01 defines a Type B family child care home as a provider's residence caring for one to seven children at a time (no more than three under age two), and a Type A home as the administrator's residence caring for eight to fourteen children. Both require licensure by the Ohio Department of Job and Family Services, background checks, inspections, and training. Separately, your township (ORC 519) or municipality may require a zoning certificate or conditional-use approval to operate a daycare in a residential district. The county itself issues no daycare license.
Operating an unlicensed home daycare violates ORC 5104 and can bring state cease-and-desist orders and penalties. Zoning non-compliance is enforced locally by the township or city.
