Operating any home occupation in Burbank requires an approved business permit under Burbank Municipal Code Section 3-4-1901, applied for on forms prescribed by the Community Development Director. The Director reviews the application against Division 11 standards, inspects the premises, and may approve, deny, revoke, or suspend the permit; it is not transferable to a different person, address, or occupation.
Under Burbank Municipal Code Title 10, Chapter 1, Article 6, Division 11, the conduct of a home occupation requires the approval of a business permit as required by Section 3-4-1901 of the Code (BMC 10-1-673.5.A). The applicant files an application on forms prescribed by the Community Development Director, provides all required information, and pays a fee set in the Code or the Burbank Fee Resolution. The Community Development Director considers the application based on the Division 11 regulations and other applicable laws, inspects the premises for compliance, and approves the application only if the home occupation complies with all requirements of the Article (BMC 10-1-673.5.B). The intent of Division 11 (BMC 10-1-671) is that a home occupation be allowed only where the business use is clearly an office use, artistic use, cottage food operation, or music lessons, is incidental and secondary to the use of the dwelling, and is compatible with surrounding residential uses. A permit cannot be transferred or assigned to a different person, address, or home occupation (BMC 10-1-673.5.C). Music lessons additionally require an Administrative Use Permit (BMC 10-1-672.M). Home-based office businesses are processed through the Building & Safety Division; the City directs prospective operators to call (818) 238-5280.
A business permit for a home occupation that is not operated in compliance with Division 11 or any other applicable law may be revoked or suspended by the Community Development Director after 15 days' notice (BMC 10-1-673.5.D). Any person may appeal a decision denying, revoking, or suspending the permit under the appeal procedures in Article 15, Title 2, Chapter 1 of the Code (BMC 10-1-673.5.E).
