All fireworks are illegal in Burbank. Burbank Municipal Code 9-1-9-5608.1(a), a local amendment to the adopted California Fire Code, flatly prohibits any person from manufacturing, possessing, selling, or discharging fireworks, with the only exception being a permitted public display. California's State Fireworks Law (Health & Safety Code section 12500 et seq.) separately bans possession of dangerous fireworks without a permit.
Burbank does not allow even 'safe and sane' fireworks. BMC 9-1-9-5608.1(a), added by Ordinance 25-4,034 (eff. 1/1/26) to Chapter 56, Part 9 of the California Fire Code, states: 'No person shall manufacture, possess, sell, or discharge fireworks,' with an exception only for fireworks display as set forth in CFC Section 5608. On top of the local ban, the California State Fireworks Law applies: Health & Safety Code section 12500 establishes the State Fireworks Law, and section 12677 makes it unlawful to possess dangerous fireworks without a valid permit. The Burbank Fire Department and Police Department confiscate fireworks and issue citations or make arrests for violations.
A violation of the Burbank Municipal Code, including this Fire Code amendment, is a misdemeanor unless classified or charged as an infraction (BMC 1-1-105). Possession of dangerous fireworks without a permit is independently unlawful under Cal. Health & Safety Code section 12677, and fireworks are subject to immediate seizure.
