El Monte Municipal Code Chapter 8.16 (Fireworks) authorizes the sale and discharge of 'Safe and Sane' fireworks bearing the California State Fire Marshal seal. Only fireworks classified as 'Safe and Sane' under California Health & Safety Code Section 12529 are legal; bottle rockets, firecrackers, Roman candles, sky rockets, M-80s, and any aerial or exploding device are 'dangerous fireworks' prohibited statewide under H&SC Section 12505. Per EMMC 8.16, retail stand sales occur June 28 noon through July 6 noon (mirroring the State Fire Marshal retail window in 19 CCR Section 999), and discharge in El Monte is permitted only July 1 through July 4 between 10:00 a.m. and 11:00 p.m. (extended on July 4). Fireworks stands require a city license and may be operated only by qualified nonprofit organizations under EMMC 8.16. The City Council reviews permitted stand operators annually.
Use or possession of dangerous (illegal) fireworks is a misdemeanor under California H&SC Section 12677, carrying fines up to $1,000 and/or up to one year in county jail. Under H&SC Section 12557, administrative fines for possession of 25 lbs. or less of dangerous fireworks are $1,000 minimum; possession of more than 25 lbs. is a felony (H&SC 12677). The El Monte Police and Fire Departments conduct enhanced enforcement around July 4; social-host responsibility can attach to property owners under H&SC Section 12557(d). Illegal use of even safe-and-sane fireworks outside permitted dates/times is a misdemeanor under EMMC 8.16 and H&SC 12680.
