§21-1303 Warning Must First Be Issued. 1. Pursuant to this Article, no person may be arrested for violating this section until he/she has first received an oral or written warning from a law enforcement agency to cease the prohibited conduct... §21-1305 Sleeping on Sidewalks, Streets, Alleys, within Doorways or on or under Bridges Prohibited. 1. No person may sleep on public sidewalks, streets, or alleyways at any time as a matter of individual and public safety. 2. No person may sleep in any pedestrian or vehicular entrance to public or private property abutting a public sidewalk. 3. Before anyone can be arrested under this Article, Sec. 21-1303 requires that a law enforcement officer first issue an oral or written warning to stop the conduct; only a second, continued violation after that warning can lead to arrest or removal from the premises. The ordinance carves out real exceptions: people down due to a medical emergency, wheelchair users, permitted parade attendees, sidewalk cafe patrons, people on public benches (short of camping on them), people waiting in a bus zone, and people queued in an orderly line for tickets, building entry, shelters, or meal service.

Children asleep in a stroller while carried by a supervising adult are also exempt. The Article applies only in unincorporated Chatham County; it does not reach Savannah's separate downtown ordinances.

Violations & Fines

A first violation draws only a warning from a law enforcement officer. If the person does not comply and continues the prohibited conduct, in addition to any other remedy provided by law, they may be arrested or removed from the location under Sec. 21-1305(4). The County Commission Chairman can suspend enforcement county-wide during a declared emergency, and the Commission can exempt a specific permitted special event by resolution.
