Summary

Unincorporated San Joaquin County hotels and short-term rentals must collect an 8% transient occupancy tax from guests staying 30 days or less.

City-specific rules exist: Stockton, Manteca, Tracy, and Lodi have their own transient occupancy tax rules that differ from San Joaquin County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

For the privilege of occupancy in any hotel, each transient is subject to and shall pay a tax in the amount of eight percent (8%) of the rent charged by the operator. Said tax constitutes a debt owed by the transient to the County which is extinguished only by payment to the operator or to the County. The transient shall pay the tax to the operator of the hotel at the time the rent is paid. If the rent is paid in installments, a proportionate share of the tax shall be paid with each installment. The unpaid tax shall be due upon the transient's ceasing to occupy space in the hotel. If for any reason the tax due is not paid to the operator of the hotel, the Tax Administrator may require that such tax shall be paid directly to the Tax Administrator.

Full Breakdown

County Code Sec. 3-4001 imposes an 8% tax on rent for occupancy in any hotel, charged to each transient: anyone occupying a room for 30 consecutive days or less. The operator collects the tax when rent is paid and, if unpaid, the County Tax Administrator can demand it directly from the transient. This applies to hotels, motels, and other short-term lodging in the unincorporated area.

Violations & Fines

Late remittance draws a 10% penalty, a second 10% penalty after 30 days' further delinquency, a 25% fraud penalty, plus 0.5% monthly interest, and unregistered/false-return operators face misdemeanor charges up to $500 and six months jail under Sec. 3-4012.
