(b)Residential structures. Under Chapter 11C, any new construction or substantial improvement of a residential structure in a Special Flood Hazard Area must elevate the lowest floor, including basement, attached garages, enclosures and detached accessory buildings, to or above the base flood elevation plus freeboard before the Department of Regulatory and Economic Resources will issue a building permit. Freeboard is defined as the stricter of one foot above the base flood elevation or the minimum required by the Florida Building Code and ASCE 24: an added safety margin beyond the bare federal standard. Coastal High Hazard Area and Coastal A Zone construction faces an additional pilings-and-anchoring requirement under Section 11C-4. The chapter applies in unincorporated Miami-Dade County (UMSA) and in portions of incorporated areas where the County retains exclusive jurisdiction over development orders and permits; each of the 34 municipalities otherwise administers its own floodplain rules.

Enforced by the Director under Chapter 24 Division 3, Section 24-7, Section 1-5 and Chapter 8CC; each day a violation continues is a separate offense, and the Director may seek injunctive relief or revoke the building permit.
