Summary

New construction and substantial improvements in Lake County's flood hazard areas must meet elevation and design standards under FBC § 1612.4 and § R322.2.1, as locally amended by Code § 6-22(j)-(k). Lowest floors must sit at or above the base flood elevation plus 18 inches, certified before vertical framing continues.

These county ordinances apply to unincorporated areas of Lake County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

R322.2.1 Elevation requirements. 1. Buildings and structures in flood hazard areas not designated as Coastal A Zones shall have the lowest floors elevated to or above the base flood elevation, plus eighteen (18) inches or the design flood elevation, whichever is higher. 2. Buildings and structures in flood hazard areas designated as Coastal A Zones shall have the lowest floors elevated to or above the base flood elevation plus one (1) foot (three hundred five (305) mm), or to the design flood elevation, whichever is higher. 3. In areas of shallow flooding (AO Zones), buildings and structures shall have the lowest floor (including basement) elevated at least as high above the highest adjacent grade as the depth number specified in feet on the FIRM, or at least two (2) feet (six hundred ten (610) mm) if a depth number is not specified. 4. Basement floors that are below grade on all sides shall be elevated to or above the base flood elevation, plus eighteen (18) inches or the design flood elevation, whichever is higher.

Full Breakdown

1 (§ 6-22(j)) so that buildings and structures in flood hazard areas outside Coastal A Zones must have their lowest floors, including basement floors below grade on all sides, elevated to or above the base flood elevation plus 18 inches, or the design flood elevation, whichever is higher; in Coastal A Zones the freeboard drops to 1 foot above base flood elevation, and in shallow-flooding AO Zones, the lowest floor must sit above the highest adjacent grade by the FIRM's depth number, or at least 2 feet if none is specified.

4 to require that buildings in flood hazard areas, including areas subject to high-velocity wave action, be designed and built to ASCE 7 Chapter 5 and ASCE 24, and that utilities and attendant mechanical, plumbing and electrical equipment be elevated at least 18 inches above the base flood elevation or higher if ASCE 7 or ASCE 24 demands it. Compliance is checked twice during construction. 1 then requires flood hazard documentation again before the final inspection and before a certificate of occupancy issues. 03.

Violations & Fines

Building below the required elevation, or skipping the lowest-floor elevation certification required under § 6-22(h) (FBC § 110.3.3) before framing continues, blocks approval to proceed and, ultimately, the final inspection and certificate of occupancy under § 110.3.11.1. The Building Official coordinates with the Floodplain Administrator on any request to modify the strict elevation standards, and unauthorized construction below the base flood elevation is treated as a code violation subject to correction orders.

Frequently Asked Questions

How high above flood level must my new home's floor sit?
At least 18 inches above the base flood elevation, or the design flood elevation if higher, under FBC R322.2.1 as amended by Code § 6-22(j). In Coastal A Zones the minimum is 1 foot above base flood elevation, and in shallow AO flood zones it's the FIRM's depth number above the highest adjacent grade, or 2 feet if none is listed.
When do I have to prove my floor elevation to the county?
Twice. Once the lowest floor is placed and before you continue vertical construction, you must submit an elevation certification to the Building Official under § 6-22(h) (FBC § 110.3.3). A final elevation certification is required again before the final inspection, under § 110.3.11.1.
What standard governs how flood-zone buildings must be built?
FBC § 1612.4, as amended by Code § 6-22(k), requires flood hazard area construction to follow Chapter 5 of ASCE 7 and ASCE 24, with mechanical, plumbing and electrical equipment elevated at least 18 inches above base flood elevation or higher if those standards demand it.
