In the City of Madison, grass, shrubs, and undergrowth other than ornamental plant growth that exceeds 12 inches in height may be declared a public nuisance and abated under the city's weed-abatement ordinance.
Madison's weed-abatement article (Code of Ordinances Ch. 22, Art. III) targets overgrown grass or weeds that harbor pests, create fire hazards, or are unsightly. The trigger height is a growth of grass, shrubs, or undergrowth, other than ornamental plant growth, exceeding 12 inches. The mayor or a designated enforcing official serves written notice on the owner, who must abate within 14 days (up to 28 for difficult cases) or request a hearing. If the owner fails to act, the city cuts the growth itself or by contract and assesses the cost.
City may abate and assess costs as a 'weed lien' added to the property tax bill; general penalty up to $500 and/or 12 months, each day a separate offense.
