Large above-ground cisterns may also need to comply with zoning setback and accessory-structure standards in the Zoning Code if they are sizable. For most homeowners, a covered rain barrel beneath a downspout is fully permitted and rebate-eligible.
There is no penalty for harvesting rainwater itself. However, a rain barrel or cistern that becomes stagnant and breeds mosquitoes is a public nuisance under EMC Sec. 8.18.030(a)(15), enforceable through abatement and potential fines under EMC Sec. 8.18.040 / Chapter 8.17.
