Eastvale requires trees, hedges and other vegetation to be kept healthy and trimmed under the EMC nuisance code. Vegetation that overhangs public sidewalks or streets, that is dead or diseased, or that creates a fire hazard is a public nuisance. Trimming of parkway and street trees in the public right-of-way is managed by the city and generally requires a permit.
On private property, EMC Sec. 8.18.030(a)(18) makes it a nuisance to let hedges, trees and other vegetation go un-pruned so they are no longer 'neat, orderly, and healthy,' or to let vegetation overhang or grow onto any public alley, highway, sidewalk, street or right-of-way so as to obstruct people or vehicles. EMC Sec. 8.18.030(a)(19) separately addresses 'dead, decayed, diseased or hazardous trees,' which owners must remove or remediate. For trees in the public right-of-way, parkways and city parks, the city adopted an urgency tree ordinance (Ordinance No. 2016-08, December 14, 2016) establishing a Tree Board and maintenance requirements for those public trees. Because parkway and street trees are on city-controlled land, residents generally cannot trim or remove them on their own; work within the public right-of-way requires an encroachment/right-of-way permit from Public Works. For development projects, the Zoning Code (EMC Sec. 120.05.040) requires landscaping and irrigation plans and that existing trees be preserved whenever practical. Routine trimming of healthy private trees is not separately permitted, but owners remain responsible for keeping them maintained and clear of public ways.
Failing to trim vegetation that overhangs public ways, or letting trees become dead, diseased or hazardous, is a public nuisance under EMC Sec. 8.18.030(a)(18)-(19). Penalties under EMC Sec. 8.18.040 are a misdemeanor or administrative fines under Chapter 8.17, with each day a separate offense. Trimming or disturbing a parkway/street tree or working in the right-of-way without a permit can trigger separate code-enforcement and permit violations.
