Mansfield permits residential rainwater harvesting with minimal restrictions. Texas Property Code 202.007 bars HOAs from banning rain barrels, and state HB 3391 encourages harvesting. Basic barrels need no permit.
The City of Mansfield supports residential rainwater harvesting consistent with Texas state policy. Texas House Bill 3391 (2011) and Texas Property Code 202.007 protect rainwater harvesting rights, and HOAs may not prohibit rain barrels or cisterns though they may impose reasonable aesthetic requirements. Basic rainwater collection systems using rain barrels or above-ground cisterns connected to downspouts typically do not require city permits. Larger systems with integrated plumbing that feeds non-potable uses inside a home (for example toilet flushing or clothes washing) require a plumbing permit and must comply with cross-connection control rules under Texas Administrative Code 290. Potable rainwater systems must meet treatment and disinfection standards under TCEQ rules. Texas Tax Code 151.355 exempts rainwater harvesting equipment from state sales tax. The Tarrant Regional Water District and WaterIsAwesome.com offer rebates and educational resources for rainwater harvesting installations. Contact the Building Division for permit questions on larger systems.
There are no penalties for standard rainwater harvesting. However, installing indoor plumbing connections without a plumbing permit may result in a code violation and required inspection. Systems creating cross-contamination risks with the potable supply must be corrected immediately.
