Florida Statute 373.62, enacted in 2019, expressly authorizes residential rainwater harvesting and prohibits local governments and HOAs from banning rain barrels on residential property. Miami Gardens does not impose any additional restrictions on rainwater collection. Rain barrels and cisterns may be installed without a city permit for residential use. Larger rainwater harvesting systems may require plumbing permits if connected to the building's plumbing system. The South Florida Water Management District encourages rainwater harvesting as part of water conservation efforts. Collected rainwater may be used for irrigation and other non-potable purposes.
No violations can be issued for properly maintained residential rain barrels. Rainwater collection systems must not create standing water conditions that breed mosquitoes.
