Tree removal permit rules in Lakeville, MN β sometimes called heritage tree, protected tree, or street tree ordinances β list which trees require a permit before you can cut them down.
Lakeville adopted a Tree Preservation Ordinance (effective August 2025) that limits tree removal during development. In residential districts, up to 40% of the total diameter inches of significant trees may be removed without replacement; removal beyond that requires replacement planting. All diameter inches of removed heritage trees require replacement. The rules apply at subdivision, site plan, and certain building-permit stages.
In August 2025, Lakeville adopted a new tree preservation ordinance designed to increase protection and preservation of trees and encourage a thoughtful approach to developing wooded areas. The ordinance applies to: new subdivisions at application; new development requiring site plan approval; infill development (new single-family or duplex on vacant lots); reconstruction or expansion of residential buildings on lots of one acre or more with heritage trees; and certain land-disturbing activities. A 'significant tree' is generally a healthy tree measuring 6 inches in diameter or greater. In residential districts, development may remove or disturb up to 40% of the total diameter inches of significant trees without a replacement requirement; removal beyond that threshold triggers replacement planting. Heritage trees β described by the City as unique to Lakeville because of their size and age β receive the strongest protection: all diameter inches of any removed heritage tree must be replaced. Replacement stock must meet the American Standard for Nursery Stock, with deciduous replacements at least 2.5 caliper inches, planted on the same property or development area. A tree preservation plan, prepared by the owner or a qualified professional (such as a licensed forester, landscape architect, ISA Certified Arborist, or Registered Consultant Arborist), is reviewed by City Forestry staff. Note: a single mature tree on an established lot, outside a development trigger, generally is not regulated for removal.
Removing or disturbing more significant-tree diameter inches than allowed, or removing heritage trees, without the required replacement plantings or an approved tree preservation plan can lead to replacement obligations and development-approval consequences. The City offers a calculation worksheet to help applicants determine thresholds and replacement requirements.
