Lane Code 9.057.576(A) declares as a nuisance any vegetation that is a hazard to pedestrian or vehicular use of a sidewalk or street by obstructing passage or vision. Specifically, vegetation encroaching upon or overhanging a pedestrian way or parking strip lower than nine feet, or overhanging a street lower than fifteen feet, is prohibited, as is vegetation that obstructs a motorist's or pedestrian's view of traffic signs, signals, street lights, name signs or other safety fixtures. The person in charge of the abutting property is responsible for keeping trees trimmed back. This applies in the unincorporated county; cities like Eugene and Springfield have their own street-tree rules.
