Unincorporated Polk County sets no permit for routine trimming of trees on private residential property. Florida law (FS 163.045) bars any local permit or fee for trimming when a certified arborist documents the tree is a danger. Utilities may trim trees near their lines.
Polk County's Land Development Code focuses landscaping and tree rules on new development (Section 720), not routine homeowner pruning. For residential property, Florida Statute 163.045 preempts local governments: no notice, permit, fee or mitigation may be required to prune, trim or remove a tree if the owner holds documentation from an ISA-certified arborist or Florida-licensed landscape architect that the tree poses an unacceptable danger. Trees along shorelines, in wetland buffers, or in conservation easements may still fall under SWFWMD or DEP jurisdiction. Inside city limits, municipal tree ordinances may impose additional trimming standards.
No county penalty for lawful trimming on residential land. Damaging a protected wetland/conservation tree can trigger SWFWMD or DEP enforcement, fines and mandatory restoration.
