Tualatin's weed rule lives in TMC Chapter 6-04. TMC 6-04-060(3) defines noxious vegetation as uncontrolled growth of weeds, brush, poison oak, poison ivy, tansy ragwort, blackberry bushes, or grasses that offers vector or rodent harborage, contributes noxious pollen, constitutes a fire hazard, or unreasonably interferes with neighboring property. TMC 6-4-090 makes it the owner's duty to cut down noxious vegetation before it becomes a hazard or goes to seed. Between March 1 and October 31 no owner may allow noxious vegetation to remain on the property or the public right-of-way abutting the property. Designated wildlife habitat conservation areas are excluded under TMC 6-04-060(3).
Allowing noxious plants β blackberry, tansy ragwort, poison oak/ivy, tall weeds β on the property or abutting right-of-way between March and October violates TMC 6-4-090. The city can abate at the owner's cost, lien the property, and assess civil penalties.
