Summary

Clayton County bans unreasonably loud truck parking, loading, and unloading noise, along with outdoor loudspeakers, between 10:00 p.m. and 7:00 a.m. under Sec. 62-3.3(17). The nighttime restriction targets delivery and commercial vehicle activity that disturbs residents trying to sleep, separate from the county's general daytime noise rules.

These county ordinances apply to unincorporated areas of Clayton County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(17)Vehicles and loudspeakers. Noises associated with (i) the parking, loading, and unloading of trucks and other vehicles, and (ii) the use of mechanical loudspeakers or amplifiers emanating outside of buildings when such noises are unreasonably loud so as to disturb a reasonable person in his or her residence any day between the hours of 10:00 p.m. and 7:00 a.m.

Full Breakdown

Sec. 62-3.3 lists specific acts the county has already declared to be loud, disturbing, and unnecessary noise violations, and item (17), "Vehicles and loudspeakers," squarely covers commercial deliveries: it prohibits noises from the parking, loading, and unloading of trucks and other vehicles, as well as mechanical loudspeakers or amplifiers operating outside of buildings, whenever that noise is unreasonably loud enough to disturb a reasonable person in their residence, and it applies specifically between 10:00 p.m. and 7:00 a.m. Outside that nine-hour window, the same activity is judged instead under the county's general noise standard in Sec. 62-3.2, which asks whether the sound is audible 50 feet from its source and disturbs a person of ordinary sensibilities.

A separate clause, Sec. 62-3.3(8), also reaches loading, unloading and opening boxes at any hour if it creates a loud and excessive noise, so an early-morning or daytime delivery is not automatically exempt; it still has to avoid crossing into loud and excessive territory even before 10:00 p.m. But the (17) nighttime rule is the one enforced most often against distribution centers, grocery stores, and retail strips that receive trucks overnight, because it does not require proving the noise was excessive, only that it was unreasonably loud enough to disturb a resident and that it fell inside the 10:00 p.m. to 7:00 a.m. window.

Nothing in Sec. 62-3.4's list of exceptions carves out delivery trucks; the towing-truck exception in Sec. 62-3.4(13) applies only to trucks assisting motorists or towing disabled vehicles, not commercial freight deliveries.

Violations & Fines

A business or driver cited under Sec. 62-3.3(17) for overnight truck noise faces prosecution as a misdemeanor under the county's general penalty, Sec. 1-12: a fine of up to $1,000.00, up to six months in the county jail, or both, per violation, with each night's incident charged as a separate offense.

Frequently Asked Questions

Can a delivery truck unload at a Clayton County business at 2 a.m.?
Only if it doesn't create noise loud enough to disturb a reasonable person in a nearby residence. Sec. 62-3.3(17) specifically bans unreasonably loud truck parking, loading, and unloading noise, along with outdoor loudspeakers, between 10:00 p.m. and 7:00 a.m., precisely the window that covers a 2 a.m. delivery.
Is daytime delivery noise ever a violation?
It can be. Sec. 62-3.3(8) separately bans loud and excessive noise from loading, unloading, and opening boxes at any hour, and the general Sec. 62-3.2 standard, audible 50 feet away and disturbing to a reasonable person, still applies outside the 10:00 p.m. to 7:00 a.m. window covered by clause 17.
What's the penalty for violating the truck-noise rule?
A citation under Sec. 62-3.3(17) is prosecuted as a misdemeanor under the county's general penalty, Sec. 1-12: a fine of up to $1,000.00, up to six months in the county jail, or both, and Clayton County treats each night's violation as a separate, chargeable offense.
