Installation requires a mechanical permit from Fort Myers Building, Permitting & Inspections (BPI), which applies the Florida Building Code, but the building code does not impose its own decibel cap. The Land Development Code includes residential-district setback and screening provisions for mechanical equipment (typically 5-foot side-yard setbacks; equipment must be screened from public view in some zoning districts), and many planned-development (PD) and site-plan approvals impose project-specific equipment-location and screening conditions. HOAs and condominium associations frequently impose stricter mechanical-equipment placement and noise rules in their covenants. For a noisy outdoor AC, heat pump, or pool pump, Code Enforcement (239-321-7940) responds on the Sec. 54-196 standard - the question is whether the equipment can be heard from the complaining neighbor's property and whether it disturbs ordinary neighborhood quiet. Florida is unusual in that HVAC use is essentially year-round, so persistent equipment noise (e.g., a failing compressor) is a common code-enforcement subject in Fort Myers neighborhoods.
No dedicated HVAC penalty. Equipment noise audible from a complainant's property is enforced under Sec. 54-196. Code Enforcement may issue a notice of violation and refer to the Special Magistrate for daily fines if uncorrected.
