Collier County's noise ordinance does not regulate aircraft. Noise from normal aircraft and airport operations, including mosquito-fogging aircraft, is expressly exempt; aircraft noise is governed by the FAA and federal law.
Sec. 54-87(I) exempts 'all noise coming from the normal operations of aircraft (not including scale model aircraft), including noise from mosquito fogging aircraft, and from the normal operations of airports within the County' from the Sound Level limits. This means the county sets no decibel cap on airport or overflight noise; that authority rests with the Federal Aviation Administration under federal law. Facilities such as Naples Airport and Immokalee Regional Airport operate under FAA rules and their own noise-abatement programs. Scale model (drone/RC) aircraft are not exempt and remain subject to Table I limits.
No county penalty applies to exempt aircraft noise. Concerns about airport or overflight noise are directed to the airport authority and the FAA, not county Code Enforcement.
