Seminole County does not regulate aircraft noise. Sec. 165.51(b) exempts 'aircraft and airport activity conducted in accordance with federal laws and regulations' from Chapter 165, because aviation noise is preempted by the FAA under federal law.
Aircraft and airport operations are outside the county's noise authority. Sec. 165.51(b) expressly exempts aircraft and airport activity conducted under federal law from Chapter 165, and railway locomotives/cars are exempt under 165.51(a). This reflects federal preemption of aviation noise (Federal Aviation Act / FAA control of navigable airspace), so complaints about overflights or airport operations go to the FAA or airport operator, not county code enforcement. Airboat noise on the water is handled separately (definitions at 165.2(a) and (dd)). Ground-based sources near an airport still fall under the ordinance.
No county penalty attaches to federally compliant aircraft or airport noise. Aviation-noise concerns are directed to the FAA or the airport authority.
