Summary

Aircraft noise gets a blanket pass under Snohomish County's noise ordinance: SCC 10.01.050(1)(a) exempts all sounds from aircraft in flight and airport flight operations from the county's maximum permissible sound levels, at all times, and subsection (2)(g) separately exempts daytime aircraft engine testing and maintenance noise.

City-specific rules exist: Everett, Edmonds, and Lynnwood have their own aircraft noise rules that differ from Snohomish County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

(1) Sounds Exempt at All Times. The following sounds are exempt, at all times, from the maximum permissible sound levels established in SCC 10.01.030(2) and 10.01.030(3), except that such sounds produced by operations or activities requiring the issuance of a Conditional Use Permit or a SEPA determination shall only be exempt in so far as the conditions of the Conditional Use Permit or SEPA determination are being complied with. (a) Sounds originating from aircraft in flight and sounds which originate at airports and are directly related to flight operations. ... (2) Sounds Exempt During Daytime Hours. The following sounds are exempt, during daytime hours, from the maximum permissible sound levels established in SCC 10.01.030(2) and 10.01.030(3) ... (g) Sounds created by aircraft engine testing and maintenance.

Full Breakdown

030(2) and (3), the numeric decibel limits that otherwise govern sound crossing a property line. That exemption applies around the clock, day or night, and it sits alongside 18 other blanket exemptions in subsection (1), covering everything from railroad and vessel operations to fire alarms and officially sanctioned parades. A second, narrower exemption in subsection (2)(g) separately excuses sounds created by aircraft engine testing and maintenance from the maximum permissible levels, but only during daytime hours, meaning that category of ground noise, unlike in-flight and airport-flight-operations noise, loses its exemption after dark.

050: if the source of the sound is subject to a Conditional Use Permit or a SEPA environmental determination, the exemption only extends as far as the noise conditions of that permit or determination allow, so a permitted airport expansion or heliport, for instance, could still face project-specific noise conditions despite the blanket aircraft exemption. The exemption reflects the reality that airport noise, including operations at Snohomish County Airport (Paine Field), is governed primarily by FAA regulation and federal noise-compatibility planning rather than local decibel limits. 050(1)(a) removes it from the ordinance's reach entirely.

Violations & Fines

There is no violation for ordinary aircraft-in-flight or airport flight-operation noise: SCC 10.01.050(1)(a) removes it from the county's decibel limits entirely. Aircraft engine testing and maintenance noise loses that protection at night under subsection (2)(g), and a complaint about it would instead be evaluated under the general quantitative standards of SCC 10.01.030, enforced under SCC 10.01.080 with civil penalties starting at $50 to $250 per infraction.

Frequently Asked Questions

Can I complain to Snohomish County about aircraft noise over my house?
Not under the county noise ordinance. SCC 10.01.050(1)(a) exempts sounds from aircraft in flight and from airport flight operations from the county's maximum permissible sound levels at all times, so the noise ordinance provides no relief for ordinary aircraft overflight noise; FAA and airport noise-compatibility programs are the applicable channels instead.
Is nighttime aircraft engine testing at an airport exempt too?
No, not fully. SCC 10.01.050(2)(g) exempts aircraft engine testing and maintenance noise from the county's sound limits only during daytime hours. At night, that category of ground noise is not covered by this exemption and could be measured against the standard limits in SCC 10.01.030.
Does the aircraft exemption ever have limits?
Yes. If the noise source is tied to activity requiring a Conditional Use Permit or a SEPA determination, SCC 10.01.050 says the exemption only holds insofar as the conditions of that permit or determination are met, so a permitted facility could still carry its own noise conditions.
