Summary

In unincorporated Washington County land near Stark's Twin Oaks Airpark, the Public Use Airport Safety and Compatibility Overlay District requires noise-sensitive buildings (homes, schools, hospitals, libraries) inside the 55 LDN noise contour to include a noise abatement design that keeps indoor noise at or below 55 LDN before a building permit issues.

City-specific rules exist: Hillsboro has its own aircraft noise rules that differ from Washington County's county-level regulations. If you live in Hillsboro, check the city-specific page instead.

Within airport noise impact boundaries, land uses shall be established consistent with the levels identified in OAR 660, Division 13, Exhibit 5. A declaration of anticipated noise levels shall be attached to any Standard Subdivision or Standard Partition approval or other land use approval or building permit affecting land within identified airport noise impact boundaries. In areas where the noise level is anticipated to be at or above 55 LDN, prior to issuance of a building permit for construction of a noise sensitive land use (real property normally used for sleeping or as a school, religious institution, hospital, public library or similar use), the permit applicant shall be required to demonstrate that a noise abatement strategy will be incorporated into the building design that will achieve an indoor noise level equal to or less than 55 LDN.

Full Breakdown

619 and OAR 660-013-0070/0080. Section 388-3 requires the county to delineate the airport's noise impact boundary, runway, approach surface and related imaginary surfaces on the Rural/Natural Resource Plan Map, and every parcel touching those boundaries is subject to the overlay's standards. A: within the mapped noise impact boundary, land uses must be established consistent with the levels in OAR 660, Division 13, Exhibit 5, and any Standard Subdivision, Standard Partition, other land use approval or building permit affecting that land must carry a declaration of anticipated noise levels.

Where the anticipated level reaches or exceeds 55 LDN, an applicant seeking a permit to build a 'noise sensitive land use,' defined in the Code as real property normally used for sleeping or as a school, religious institution, hospital or public library, must demonstrate before permit issuance that the building design incorporates a noise abatement strategy achieving an indoor noise level of 55 LDN or less. Section 388-6 layers on a companion procedural requirement: any Type II or III application inside the overlay must submit a map showing the property relative to the airport's imaginary surfaces, scaled elevation profiles and a site plan, and, if a height variance is sought, letters of support or 'no impact' from the airport sponsor, the Oregon Department of Aviation and the FAA.

Section 388-4 requires written notice of land use applications in the overlay, including comprehensive plan amendments, to go to both the airport sponsor and the Department of Aviation. The overlay's reach is narrow: Section 388-2 currently applies it only to the area around Stark's Twin Oaks Airpark, not county-wide, though the Code allows it to extend to other public-use airports the Department of Aviation later identifies as needing this protection.

Violations & Fines

Building without the required noise abatement showing means the county Land Development Services Division can deny or condition the building permit until an indoor-noise design is submitted; a permit issued without the Section 388-7.A declaration is subject to challenge on appeal under the Code's Type II/III procedures. There is no separate cash penalty specified in Section 388 itself; enforcement runs through withholding or conditioning the permit.

Frequently Asked Questions

Does this rule apply everywhere in Washington County?
No. Section 388-2 applies the Public Use Airport Safety and Compatibility Overlay District only to the area surrounding Stark's Twin Oaks Airpark inside unincorporated county land. The Code allows the county to extend it to other public-use airports later, but as written it is not a county-wide noise rule and does not reach incorporated cities like Hillsboro or Beaverton.
What has to happen before I can get a building permit inside the 55 LDN contour?
Under Section 388-7.A, if the site is anticipated to reach 55 LDN or higher, you must demonstrate a noise abatement strategy in the building design that will hold indoor noise to 55 LDN or below before the county issues a building permit for a noise-sensitive use such as a dwelling, school, religious institution, hospital or library.
What extra paperwork does a Type II or III application need in this overlay?
Section 388-6 requires a map showing the property against the airport's imaginary surfaces, elevation profiles and a scaled site plan showing structure heights in feet above mean sea level, and, if you are requesting a height variance, support or no-impact letters from the airport sponsor, the Department of Aviation and the FAA.
