In unincorporated Leon County, construction, demolition, alteration, or repair of buildings (and excavation of streets/highways) is a per se noise violation outside 7:00 a.m.-8:00 p.m. on weekdays and Saturdays and 9:00 a.m.-5:00 p.m. on Sundays (Code of Laws Sec. 12-56(10)). Emergency work is exempt.
Leon County's construction-noise hours appear in the Noise Control article, Sec. 12-56(10) of the Code of Laws (Ch. 12, Art. II; Ord. No. 08-08). The construction, demolition, alteration, or repair of any building, and the excavation of streets and highways, may occur only between 7:00 a.m. and 8:00 p.m. on weekdays and Saturdays, and between 9:00 a.m. and 5:00 p.m. on Sundays; work outside those windows is a per se violation. The provision expressly does not apply to the delivery and installation of concrete and other materials associated with residential slab installation, and construction or repair noise in cases of emergency is exempt. Several broader exemptions in Sec. 12-57 also apply: government repairs or excavations of bridges, streets, or highways may run from 8:00 p.m. to 7:00 a.m. when daytime work is impractical (Sec. 12-57(5)); and nonresidential and multifamily residential construction projects approved and permitted by the county are exempt (Sec. 12-57(9)). The article applies only outside the City of Tallahassee (Sec. 12-53). The Leon County Sheriff enforces (Sec. 12-58).
Construction noise outside the permitted hours is a civil infraction punishable by a fine not to exceed $500.00 (Sec. 12-59(a)), with each day of a continuing violation a separate offense (Sec. 12-59(b)). The Sheriff has primary enforcement responsibility and may seek voluntary compliance by warning or notice before citing (Sec. 12-58).
