Seminole County's noise ordinance does not set fixed construction start/stop times. Instead, Sec. 165.51(h) exempts 'construction activities proceeding under a valid governmental permit' from Chapter 165 entirely, so permitted job sites are not bound by the 11 p.m.-7 a.m. residential limits.
Chapter 165 lists exemptions in Sec. 165.51. Subsection (h) exempts construction activities carried out under a valid governmental permit. 'Construction activities' is defined broadly in Sec. 165.2(f) as work incidental to erection, demolition, installation, land clearing, grading, excavating, and filling. Note the power-tool limit in Sec. 165.24 expressly 'excludes construction equipment used for construction activities.' Unpermitted construction noise can still be a general noise disturbance under Sec. 165.21. Public-works projects contracted by a government agency are also exempt (165.51(i)).
No time-of-day penalty for permitted construction. Unpermitted construction creating a noise disturbance is enforced under Sec. 1.8, Seminole County Code (165.61), with each day a separate offense.
