Construction hours in Polk County, FL — sometimes called construction noise rules or contractor work-hour ordinances — set when contractors can run power tools, hammers, and heavy equipment.
Permitted construction in unincorporated Polk County is exempt from the noise ordinance only when it happens between 6:00 a.m. and 9:00 p.m. Construction noise outside that window is not exempt and can be cited as a prohibited noise disturbance.
Sec. 10.5-51(12) of the Polk County Noise Control Ordinance exempts "Construction activities exempt from, or for which Polk County has issued a development permit; provided such activity occurs between 6:00 a.m. and 9:00 p.m." The same 6 a.m.-9 p.m. window applies to organized athletic contests (12), lawful public gatherings (18), and lawn/tree equipment (19). Outside those hours the exemption is lost and the general noise-disturbance prohibition (Sec. 10.5-53) applies. This governs unincorporated county land; incorporated cities set their own construction-hour rules.
Construction noise outside 6 a.m.-9 p.m. loses its exemption and is enforceable as a noise disturbance: misdemeanor, fine up to $500 or up to 60 days jail (Sec. 10.5-54).
