CCC 9.14.010 states that proof of violating the WAC 173-60 noise limits is prima facie evidence of a county violation. WAC 173-60-040 sets maximum permissible levels by the receiving property's EDNA class. For Class A (residential) receiving property the limits are 55 dBA (residential source), 57 dBA (commercial), and 60 dBA (industrial). Short exceedances are allowed: 5 dBA for 15 minutes, 10 dBA for 5 minutes, or 15 dBA for 1.5 minutes in any hour. Nighttime limits drop 10 dBA at residences.
Exceeding WAC 173-60 levels is prima facie proof of a CCC 9.14.010 misdemeanor: $250 fine and/or 90 days jail; state Ecology may also enforce WAC 173-60.
