Playing musical instruments on public rights-of-way is unlawful between 8:00 p.m. and 9:00 a.m. without a permit; amplified sound in parks and recreation areas is barred when plainly audible between 8:00 p.m. and 10:00 a.m.
City Code Sec. 66-205 makes it unlawful to play musical instruments on public rights-of-way between 8:00 p.m. and 9:00 a.m., unless a temporary permit is obtained under Sec. 66-176 (a $20 permit for short-duration sound events). Street performers are otherwise permitted during the day. Sec. 66-203(3)b separately bars operating any radio, instrument or sound device that is plainly audible to others between 8:00 p.m. and 10:00 a.m. in parks, playgrounds or recreation areas without a permit. Sec. 66-203(3)a caps amplified public sound at 80 decibels averaged at 50 feet.
Misdemeanor under Sec. 66-140: fine up to the state maximum and/or up to 90 days jail. Police or the Health Department may issue an immediate cease order.
