Motor vehicles on public roads are exempt from Prince George's County's noise ordinance because that noise is governed by state law. The county does regulate off-road recreational vehicles and vehicle horns on private property.
Under County Code § 19-123(b)(5), motor vehicles on public roads are exempt from the Subtitle 19 noise limits, since on-road vehicle noise is regulated under Maryland state law. However, the county reaches vehicle-related noise on private property: § 19-122 lists sounding a horn or signaling device on a motor vehicle on private property (except in an emergency, or as a daytime danger-warning signal that meets the limits) as a prohibited act. The county also bars operating an off-road recreational vehicle — such as a dirt bike, ATV, go-cart, or snowmobile — on private property closer than 300 feet to a neighboring residence without the affected resident's written permission, unless it stays within the § 19-122(a) limits.
Off-road recreational vehicle and private-property horn violations can result in a civil citation or misdemeanor fine up to $1,000 for a first offense; on-road vehicle noise is handled under state traffic law.
