Summary

Loud or modified vehicle exhausts, engines and other vehicle-related noise are enforceable in unincorporated Collier County under Sec. 54-93(D)(2) without needing a decibel meter reading. An officer and a complainant simply have to agree the sound is unreasonably loud, raucous, jarring or a nuisance at a residential site. The Sheriff's Office, not Code Enforcement, handles on-road vehicle noise complaints.

These county ordinances apply to unincorporated areas of Collier County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(1)Unreasonably loud, raucous or jarring: (is clearly annoying or clearly disturbing to any individual of normal sensibilities at such site); or(2)A nuisance: (without reasonable justification is unreasonably interfering with the peace and quiet of any individual of normal sensibilities at such site). ... (2)Vehicle (including motor vehicle) including the total volume of noise from the vehicle or from any part thereof including motor/engine, if any. This includes all vehicles for which any part of the vehicle's original manufacturer's exhaust system is modified or removed, and all vehicles that are out of repair and any vehicle related sound producing device that is out of repair. These noises are enforceable by the Sheriff's Office, but shall not be enforceable by Code Enforcement officers unless the location of the source of such noise is off road.

Full Breakdown

Most of Collier County's noise ordinance requires a calibrated Sound Level Meter reading against Table I limits, but Sec. 54-93 carves out a narrower, faster path for four categories of noise, including vehicles, that officers can cite without any equipment. To use it, the noise-affected site must be classified residential under Sec. 54-92(a), and an enforcement officer together with the complainant must observe, by listening, that the sound is either unreasonably loud, raucous or jarring, or a nuisance that unreasonably interferes with the peace and quiet of an ordinary person.

Subsection D(2) applies this standard to vehicle noise: the total volume from the vehicle or any part of it, including the motor or engine, and specifically covers vehicles whose original factory exhaust system has been modified or removed, or that are out of repair, along with any vehicle-related sound-producing device that is out of repair. Jurisdiction is split by location: the Sheriff's Office enforces this vehicle-noise standard, and Code Enforcement officers may only step in when the noise source is off the road. Separately, Sec. 293 for decibel-tested violations, and Sec. 54-93(D)(4) exempts noise typical of a lawful business's normal hours and operations.

Violations & Fines

A cited vehicle-noise violation carries the same fine ladder as the rest of the noise ordinance under Sec. 54-90: $100 for a first offense, $250 for a second, and $500 for a third or later offense, each set by the Code Enforcement Board, Special Magistrate or a court. Where the same offending vehicle triggers three adjudicated violations within 12 months, the equipment or vehicle sound source may be confiscated until the owner shows it will run within the ordinance's limits.

Frequently Asked Questions

Can I report a neighbor's loud modified exhaust in Collier County?
Yes. Sec. 54-93(D)(2) lets the Sheriff's Office cite vehicle noise, including a modified or missing factory exhaust, without a decibel meter, so long as an officer and the complainant agree the sound is unreasonably loud or a nuisance at a residential site. Code Enforcement officers can only act if the noise source is off the road.
Does Collier County require decibel testing for loud vehicles?
Not under Sec. 54-93. It applies only to noise-affected sites classified residential and lets an enforcement officer cite vehicle noise based on direct observation with the complainant present, rather than a Sound Level Meter reading. Separately, F.S. §§ 316.272 and 316.293 let the Sheriff pursue exhaust or decibel-based violations statewide.
Who handles a loud vehicle parked off the road versus on a public street?
The Sheriff's Office enforces on-road vehicle noise under Sec. 54-93(D)(2) and Sec. 54-90(H); Code Enforcement officers are barred from acting unless the noise source is located off the road. That split applies to both the ordinance's vehicle-noise standard and Florida's statutory exhaust and decibel rules.
What's the penalty for a vehicle-noise violation?
Fines follow Sec. 54-90's schedule: $100 for a first violation, $250 for a second, and $500 for a third or later violation, each set by the Code Enforcement Board, Special Magistrate or a court. Three adjudicated violations from the same sound source within 12 months can lead to confiscation of the offending equipment.
