Sec. 54-118(d)(8) exempts 'motor vehicles and boats provided that they are functioning with all manufacturers' mufflers and sound reduction equipment installed and in proper operating condition' from the section's decibel limits. Remove or modify that equipment, an aftermarket exhaust, a blown or missing muffler, a straight-piped motorcycle, and the vehicle is no longer exempt and can be measured like any other Generating Property against Table I: 65 dBA/70 dBC in a residential zone by day, 55 dBA/60 dBC at night. The countywide noise article layered on top of the sound-control section, Sec.
54-153(b), separately makes it a violation to sound 'any horn or signaling device for any unnecessary or unreasonable period of time,' and to operate a car radio, tape player, or amplifier 'in such a manner as to disturb the peace, quiet and comfort of the neighboring inhabitants or with greater intensity than is necessary for convenient hearing for the Person or Persons who are in the room, vehicle or chamber' where it is playing. That provision, unlike Sec. 54-118, applies throughout the County, including inside the cities.
Motorcycles and off-road recreational vehicles fall within the section's broad definition of Motor Vehicle in subsection (a)(16), so a modified motorcycle exhaust is treated the same way as a car's.
Violations & Fines
A vehicle or boat running without its manufacturer mufflers in proper condition, or a stereo audible well beyond the vehicle interior, draws a warning first, generally two calendar days to correct for vehicular sound emissions rather than the 15-minute window used for stationary sources. A violation that continues past that period, or recurs within 90 days, is referred to code enforcement or prosecuted as a criminal offense, with a fine up to $500.00, up to 60 days in jail, or both, per violating day.
