Collier County treats loud vehicles, including those with modified or removed exhaust or defective mufflers, as a noise violation. Such vehicle noise is enforced by the Sheriff's Office and can be cited without a decibel meter.
Sec. 54-93(D)(2) covers 'the total volume of noise from the vehicle or from any part thereof including motor/engine,' expressly including vehicles whose original manufacturer's exhaust system is modified or removed and vehicles out of repair. On-road vehicle noise is enforced by the Sheriff's Office, not Code Enforcement, unless the source is off-road. Standard on-road motor-vehicle noise governed by state law (F.S. 316.293) is exempt from the local ordinance under Sec. 54-87(J). Sound-producing devices such as car stereos and horns are similarly regulated when clearly loud or a nuisance.
Cited by the Sheriff's Office as a noise violation under Sec. 54-90 ($100/$250/$500). State exhaust/muffler rules under F.S. 316.272 and 316.293 also apply on public roads.
