Gaston County, NC Noise Ordinances: Vehicle Noise (2026)

Section 8-1(a) treats vehicle noise as three distinct violations rather than one general muffler rule. Subsection (1) bars the unnecessary or excessive sounding of any horn or signaling device on an automobile, bus, truck, motorcycle or other vehicle on a street, public place or private property, except as a warning of danger, and also bars sounding a horn for an unreasonable length of time or producing an unreasonably loud or harsh sound with one. Subsection (6) covers exhaust: discharging exhaust from a steam engine, stationary internal combustion engine, motor vehicle, motorboat or aircraft into the open air except through a muffler or other device that effectively prevents loud or explosive noises is unlawful, though the ordinance builds in a rebuttable presumption that a vehicle equipped with a nondefective, manufacturer-specified muffler or noise suppression device does not violate the section, which protects a stock exhaust system even if it is loud by nature.

Subsection (7) separately targets defective vehicles or loads, prohibiting the use of any motor vehicle so out of repair or loaded in such a manner as to create loud or unnecessary grating, grinding, rattling or other noise, aimed at trucks hauling loose cargo or vehicles with failing suspension components. As with amplified sound, section 8-2's list of factors, including whether the noise is natural or unnatural in origin and its proximity to residential sleeping facilities, guides officers in close cases, and the exemptions in section 8-1(b) and (c) for emergency vehicles and permitted temporary activities apply across all three vehicle subsections.
