Carlsbad regulates BBQ grills and propane equipment through the California Fire Code adopted in CMC Title 17. Propane grills are prohibited on combustible balconies or within 10 feet of combustible construction for multifamily and townhome buildings (CFC 308.1.4). Single-family homes are generally exempt from this setback.
Carlsbad adopts the California Fire Code (CFC) by reference under CMC Title 17. CFC 308.1.4 prohibits the use of open-flame cooking devices on combustible balconies or within 10 feet of combustible construction at apartments, condominiums, townhomes, and other R-2 occupancies. Exceptions allow LP-gas containers up to 1 pound, electric grills, and dwelling units protected by automatic fire sprinklers (CFC 308.1.4 exceptions). Single-family R-3 detached homes are not subject to this 10-foot setback. CFC 6101 limits residential LP-gas (propane) storage to a total of 2 propane cylinders not exceeding 5 gallons each (about 20 pounds each) for one-family and two-family dwellings; storage on rooftops, in basements, or below grade is prohibited (CFC 6109.13). Cylinders must be stored upright outside the dwelling in a well-ventilated area, never in a garage attached to living space if heating equipment is present. During Red Flag Warnings issued by the National Weather Service, the Carlsbad Fire Marshal may issue temporary BBQ restrictions. Charcoal grills are subject to the same setback rules as propane on multifamily balconies.
Violations of the California Fire Code are misdemeanors under CFC 109 carrying fines up to $1,000 per day. Operating a propane grill on a multifamily balcony can result in fire-marshal correction notices, immediate impoundment of the equipment, and citations. HOAs often impose their own grill bans that go beyond the Fire Code and are enforced through the HOA under Davis-Stirling.
