Smoker-related violations are enforced as nuisance complaints under CMC 6.04 or as Fire Code violations under CMC 17 with administrative citations starting at $100 (CMC 1.08). Persistent smoke causing demonstrable harm to neighbors can also trigger APCD enforcement under Rule 51 with civil penalties. Operating a smoker in violation of HOA rules is enforced through the HOA, not the city.
