Escondido has adopted the 2022 California Fire Code through Chapter 11, Article 2, Division 1 of the Escondido Municipal Code (Ordinance 2025-10). CFC Β§308.1.4 prohibits open-flame cooking devices (charcoal, wood) and propane tanks larger than 2.5 lbs on combustible balconies or within 10 feet of combustible construction at apartments and condos with three or more units. Single-family backyard grilling is permitted; the San Diego Air Pollution Control District (SDAPCD) governs open burning.
Escondido enforces the California Fire Code (CFC) through Chapter 11, Article 2, Division 1 of the Escondido Municipal Code, most recently amended by Ordinance 2025-10 adopted December 17, 2025. CFC Β§308.1.4 (carried over from IFC Β§308.1.4 with California amendments) prohibits the use of charcoal burners, open-flame cooking devices, and other open-flame appliances on combustible balconies or within 10 feet of combustible construction in buildings containing three or more dwelling units. LP-gas containers larger than 2.5 pounds are also restricted at multi-family balconies. Exceptions apply where the building is fully sprinklered or only listed electric grills are used. For single-family detached homes, backyard grilling is generally permitted. Open burning of vegetation or other materials requires a Miscellaneous Burn Permit from Escondido Fire and an APCD Burn Permit from the San Diego Air Pollution Control District (Regulation IV / Rule 100-series); cooking fires using commercially manufactured BBQ or cooking appliances are exempt from the burn-permit requirement. Note Escondido lies within SDAPCD jurisdiction β not the South Coast AQMD β so SCAQMD No-Burn Day rules do not apply. SDAPCD does not currently operate a wintertime No-Burn Day program for residential grills.
CFC Β§308 violations at multi-family buildings are subject to administrative fines and possible immediate removal orders from the Escondido Fire Marshal. Unpermitted open burning is a violation of both Chapter 11 and SDAPCD Regulation IV, with administrative penalties from the Air District up to $1,000+ per occurrence. Building owners can be cited for tolerating known violations.
