Unincorporated Orange County's Fire Code adds permit and clearance rules for outdoor fireplaces and fire pits at apartments and other Group R buildings, but portable barbecues and grills used solely for cooking are expressly excepted.
307.6 Outdoor Fireplaces, Fire Pits, Fire Rings, or similar devices used at Group R Occupancies. Outdoor fireplaces, fire pits, fire rings, or similar exterior devices used at Group R occupancies shall comply with this section. Exception: Barbeques, grills, and other portable devices intended solely for cooking.

Full Breakdown
Orange County's Fire Code amendments require Building Department approval and set clearance distances for gas-fueled outdoor fireplaces, fire pits and fire rings at Group R occupancies, including apartment buildings, under Section 307.6.1: three feet from combustible construction at single-family (R-3) homes, ten feet at other Group R occupancies. Section 307.6 itself, though, expressly excepts "Barbeques, grills, and other portable devices intended solely for cooking" from that entire section. A propane or natural-gas grill used only to cook a meal does not trigger the permit or clearance rules that apply to a fixed fire pit or outdoor fireplace on unincorporated-area property.
Violations & Fines
A portable grill needs no permit under the exception. A fixed gas fire pit or fireplace installed without Building Department approval, or built closer than the required 3- or 10-foot clearance, can draw an OCFA correction order.
