Single-family homeowners in New Orleans can grill with propane or charcoal outdoors freely. In apartments, condos and other multi-family buildings the adopted fire code bars using or storing gas, charcoal or open-flame grills on balconies or within 10 feet of the structure.
New Orleans' Fire Prevention Code adopts the International Fire Code, whose open-flame cooking rule provides that for buildings other than one- and two-family dwellings, charcoal burners and other open-flame cooking devices may not be operated on combustible balconies or within 10 feet of combustible construction. That means apartment and condo residents cannot fire up a gas or charcoal grill on the balcony or right against the building, and grills or cylinders cannot be stored there. Listed, permanently installed appliances and electric grills that produce no open flame are exceptions. NOFD safety guidance adds that grills should sit well away from the home, deck railings, eaves and overhanging branches, and be used outdoors only.
Grilling on a multi-family balcony violates the adopted fire code; NOFD can order removal of the grill and cylinders and issue a citation to the resident or property.
