There is no Hamilton County barbecue ordinance; grilling safety comes from the statewide Ohio Fire Code (OAC 1301:7-7-03). Paragraph 308.1.4 prohibits charcoal burners and other open-flame cooking devices on combustible balconies or within 10 feet of combustible construction. Exceptions cover one- and two-family dwellings, buildings/balconies protected by sprinklers, and LP-gas cooking devices whose container holds no more than about 2.5 pounds water capacity (a nominal 1-pound cylinder). Apartment and condo residents (Group R-2) therefore generally cannot use full-size propane or charcoal grills on balconies unless the building is sprinklered or the fire code official approves. Many complexes impose stricter no-grill lease rules.
Fire code officials can order removal of prohibited grills and cite violators; apartment managers may enforce lease bans independently.
