Montgomery County bans charcoal, other fuel-burning, or electric cooking equipment within 20 feet of any multi-family building, though attached townhouses and rowhouses with no stacked units are exempt from the setback.

These county ordinances apply to unincorporated areas of Montgomery County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

The use of charcoal burning, other fuel burning or electric cooking equipment outside of any multi-family dwelling shall be prohibited unless such cooking equipment is at least twenty (20) feet from every part of the building. The provisions of this section shall not apply to townhouses, row houses or other multi-family dwellings where all dwelling units are side by side and none are superimposed above another.

Full Breakdown

Sec. 22-81 of the Montgomery County Fire Safety Code prohibits charcoal, other fuel-burning, or electric cooking equipment -- grills, smokers, and similar devices -- outside a multi-family dwelling unless placed at least 20 feet from every part of the building. Townhouses and rowhouses whose units sit side by side, with none stacked above another, are exempt. Sec. 22-82 separately bans charcoal-fired stoves or grills inside buildings, trailers, and other confined areas unless the unit vents combustion gases directly outside through an approved system. The Fire Chief and the Director of Permitting Services jointly administer and enforce Chapter 22 countywide.

Violations & Fines

No penalty is specified for Sec. 22-81 or 22-82, so under Sec. 1-19 each is a default Class A violation: up to $1,000 and 6 months jail, or a $500 civil fine ($750 for repeats).
